What is Mediation?
Mediation is an informal way for people to come together and
work to resolve their disputes in a non-adversarial setting.
It is a process where people in conflict seek mutually
acceptable solutions with the help of a trained professional
mediator.
The nature of mediation and the role of the mediator
Mediation encourages cooperative problem solving. Your
neutral mediator maintains order during the mediation and
makes certain both sides are heard and treated with respect.
The mediator is not an advocate. The mediator does not
decide the outcome and cannot force the parties into a
settlement. Rather, the mediator keeps everyone focused and
facilitates the exchange of information. The mediator
assists people in communicating and reaching their own
agreements.
The advantages of mediation
It is private and confidential.
The mediator, the parties, their lawyers, and any other
participants in the mediation are required to keep all
discussions and information exchanged during the mediation
confidential, avoiding public disclosure.
It is faster and less expensive than litigation
The primary advantage of mediation is that it may lower
the overall cost of completing your case. It may also save
you time, as it often takes a year or more to move a lawsuit
through the courts.
The parties control the outcome, not a judge or jury
Mediation is held in a private, cordial, and relaxed
atmosphere where the parties determine the end result.
It is less stressful
Although approved by the courts, there are no
courtrooms. The majority of mediations are held in
conference rooms that provide a comfortable atmosphere,
enabling you to focus on reaching a resolution rather than
worrying about the legalities that surround courtroom
